1. Scope

These terms and conditions of sale apply to sales concluded on www.rayonrando.com between Rayon Rando (the “Seller”) and any individual acting for non-professional purposes (the “Customer”). The Customer accepts them by confirming their order. The applicable terms and conditions are those in force on the order date; they are archived and can be consulted on the website at any time.

2. Products

The essential characteristics of products are shown on their product pages. Photographs are as accurate as possible but do not bind the Seller regarding details of colour or appearance.

3. Availability

Only products in stock in our warehouse are offered for sale. If, despite real-time stock monitoring, an ordered product proves unavailable, the Customer will be informed without delay and may choose a replacement product or a refund of the sums paid for that product, within 14 days at the latest.

4. Orders

The order is concluded when the Customer confirms it after checking their basket, delivery address, delivery method and total price, and accepting the terms and conditions of sale. The Seller acknowledges receipt by email. The data recorded by the ordering system constitute evidence of the nature, content and date of the order.

The Seller may refuse an order from a Customer with whom there is a payment dispute, or an order that is abnormal for personal use.

5. Prices

Prices are stated in euros, including all taxes (French VAT), excluding delivery costs. Delivery costs are shown before the order is confirmed and on the Delivery costs page. The price charged is the price displayed when the order is confirmed.

6. Payment

The order is payable in full when placed, by payment card (CB, Visa, Mastercard), Apple Pay, Google Pay, Revolut Pay or bank transfer. Card, Apple Pay, Google Pay and Revolut Pay payments are processed by Revolut, an authorised payment service provider, through a secure interface; the Seller never has access to card details.

The order is processed only once payment has been accepted. If payment is declined, the order is cancelled and the Customer is informed by email.

7. Delivery

Orders are dispatched from our warehouse to metropolitan France and the countries listed on the Delivery times and arrangements page, using the carriers and subject to the delivery times and weight and size limits stated there. Orders paid for before 13:00 on a working day are dispatched the same day. Unless another delivery time is stated when ordering, the product will be delivered no later than 30 days after the order.

In the event of a delay, after unsuccessfully requesting delivery within a reasonable additional period, the Customer may terminate the contract under the conditions of Articles L216-6 et seq. of the French Consumer Code.

The risk of loss or damage to products passes to the Customer when they, or a third party designated by them, take physical possession. We recommend checking the parcel on receipt and reporting any irregularity to the carrier and to contact@rayonrando.com as soon as possible to facilitate handling of the claim.

8. Right of withdrawal

The Customer has 14 days from receipt of the product (or the last product for an order delivered in several instalments) to withdraw without giving a reason. They must notify their decision by email to contact@rayonrando.com, using the website contact form or the form below, then return the product no later than 14 days after this notification to the following address:

Rayon Rando – Seillery Transports
6 allée Jean Beaulieu
49800 Trélazé, France

The product must be returned new, complete, in its original packaging, with its labels and accessories, together with the return slip. The Customer may be held liable for any diminished value resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.

Return costs are payable by the Customer. As an exception, one return per Customer is free for products from the “Men's clothing”, “Women's clothing” and “Footwear” categories returned from France; the Customer must request a return label from contact@rayonrando.com. This offer does not apply to orders placed to try several sizes or models of the same product.

The Seller refunds all sums paid, including the original delivery costs (based on the cheapest standard delivery method offered), within 14 days of notification of withdrawal, using the payment method used for the order. The Seller may withhold the refund until receipt of the product. At the Customer's request, the refund may be replaced with an exchange or voucher.

The right of withdrawal does not apply to goods unsealed by the Customer after delivery which cannot be returned for hygiene or health protection reasons, or to goods made to the Customer's specifications (Article L221-28 of the French Consumer Code).

Withdrawal form (complete and return only if you wish to withdraw):

9. Statutory guarantees

The Seller is bound by the statutory guarantee of conformity (Articles L217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), under the conditions reproduced below. These guarantees apply independently of any manufacturer's commercial warranty.

The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity, and not the date on which it appeared.

Where the sales contract for the goods provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or service throughout the agreed supply period. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or service, and not the date on which it appeared.

The statutory guarantee of conformity requires the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the statutory guarantee of conformity is renewed for two years from the date the goods are replaced.

The consumer may obtain a reduction in the purchase price and keep the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:

1° The trader refuses to repair or replace the goods;
2° Repair or replacement takes place after thirty days;
3° Repair or replacement causes significant inconvenience to the consumer, particularly where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4° The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a reduction in the price of the goods or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for use because they are being repaired or replaced suspends the remaining guarantee period until the repaired goods are delivered.

The rights mentioned above arise from Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs implementation of the statutory guarantee of conformity in bad faith may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles them to a price reduction if they keep the goods, or a full refund in exchange for returning them.

For any request, the Customer should contact customer service at contact@rayonrando.com or using the contact form, providing their order number, a description of the defect and photographs. The procedure is detailed on the After-sales service page.

10. Retention of title

The products remain the Seller's property until the price has been paid in full.

11. Personal data

The data collected when ordering are necessary for order processing, delivery, invoicing and after-sales service. Their processing is described in the privacy policy. The Customer may register free of charge on the Bloctel telephone marketing opt-out list (www.bloctel.gouv.fr).

12. Complaints and mediation

All complaints should first be addressed to customer service: contact@rayonrando.com, or Rayon Rando, 28 route de Montrigon, 73700 Bourg-Saint-Maurice.

In accordance with the French Consumer Code provisions on the consumer dispute mediation process, after contacting us and if you do not receive a satisfactory response, you may use the following consumer mediation service free of charge:

CM2C, 49 rue de Ponthieu, 75008 Paris
Telephone: 01 89 47 00 14

Email: litiges@cm2c.net

13. Applicable law

These terms and conditions of sale are governed by French law. Failing an amicable agreement, disputes shall be brought before the competent court under the rules of the French Code of Civil Procedure; a consumer Customer may bring proceedings before the court for the place where they lived when the contract was concluded or the harmful event occurred.
